Protect the Executive Power to Cancel Student Debt

We, the undersigned, urge Congress to protect the President’s and Education Secretary’s executive power to cancel student debt. The current reconciliation package proposes a limitation on the authority of the secretary to propose or issue regulations and executive actions. This section amends the Higher Education Act of 1965 by stripping away the ability for student loan debt to be pardoned by an executive action.

We call upon Congress to:

- Remove the “limitation on authority of the secretary to propose or issue regulations and executive actions” section from the reconciliation budget proposal.

- Preserve the autonomy of the Education Secretary and President to be able to enact executive actions and issue regulations without congressional approval.

- Protect the future of higher education by allocating funding to universities, research, and educational grants.

- Offer financial relief for Americans with student loan debt.

By taking these actions, Congress can uphold its commitment to checks and balances by not limiting the power of another branch of government. This section must be removed to prevent the limitation of decisions outside of their jurisdiction.

Pursuing an education in the United States should be debt-free and not result in massive amounts of student debt. While the conversation surrounding student loan debt cancellation has been mostly paused, it is crucial to strike down proposals like these to leave the door open for future administrations. Congress should not limit the power of the executive branch of government, as it is unconstitutional.

A student loan debt-free America is possible and would improve the lives of millions of families and individuals and the economy. To increase the quality of life and resurrect the American dream, lawmakers must prioritize funding education and expanding educational opportunities.
